Intellectual property and acceptable use

1. Who we are

RaceWatch is owned and operated by RaceWatch Ltd, a company registered in England and Wales (company number 17052478), registered office 147 Eastfield Road, Hull, HU4 6DU ("RaceWatch", "we", "us"). All rights described on this page belong to RaceWatch Ltd unless stated otherwise.

2. What we own

RaceWatch Ltd owns, or holds under licence, all rights in:

• the RaceWatch name, logo, wordmark, colours and look and feel of the service;
• the names of our products, scores and features, including RaceWatch Score (RWS), GQS, HT+, Double Vetted, FormLines+, Speed+, Tracker+, Filter+, Marks+, Angles, Race Fit, Trends+, Pulse, Acca Builder and our alert channels;
• our scoring models, ratings, rankings, signals, alerts, angles, verdicts and every other output the service produces;
• the methods behind them: our features, inputs, weightings, thresholds, rules, model files and training processes;
• our software, source code, interfaces, page designs and layouts;
• our written content: guides, explanations, verdicts, comments, reports, charts, emails and social posts;
• our databases, including the selection, arrangement, cleaning, matching and enrichment of racing, market and performance data.

These are protected by copyright, database right, the law of confidence and, where applicable, trade mark law, including under the Copyright, Designs and Patents Act 1988 and the Copyright and Rights in Databases Regulations 1997.

3. Trade marks

RaceWatch, RWS, GQS, FormLines+, Speed+ and Tracker+, and our other product names, are trade marks of RaceWatch Ltd. You may not use them, or any confusingly similar name, for any product, service, website, social account or domain without our written permission.

4. Confidential methods

How our scores, signals and alerts are calculated is confidential. We publish general explanations so members understand what they are looking at. We do not publish, and you are not licensed to work out or recreate, the specific inputs, weightings, thresholds or rules. Access to the service is given on the basis that you will keep this information confidential.

5. Your licence as a member

When you subscribe, we give you a personal, non-exclusive, non-transferable, revocable licence to use RaceWatch for your own private, non-commercial research while your subscription is active. Everything not expressly licensed to you is reserved.

6. What you must not do

You must not, and must not help or allow anyone else to:

1. copy, scrape, crawl, harvest, bulk download or systematically extract any part of RaceWatch, by any means, including bots, scripts, browser extensions or manual copying;
2. republish, redistribute, sell, share or broadcast our scores, ratings, signals, alerts, angles, verdicts, data or content, whether free or paid, including in tipping services, Telegram or WhatsApp groups, Discord servers, websites, apps, newsletters, spreadsheets or social media;
3. use RaceWatch, or anything taken from it, to design, build, train, test, benchmark or market a product, service, model or dataset that competes with RaceWatch;
4. reverse engineer, decompile or attempt to recreate our models, methods, thresholds or software, including by analysing our outputs in bulk;
5. use any part of RaceWatch to train or feed any artificial intelligence or machine learning system;
6. sign up, or keep a subscription, for the purpose of researching, copying or competing with RaceWatch, on behalf of yourself or any other business;
7. share your login, or let anyone else use your account;
8. remove or hide any notice, credit or marker in our content or data;
9. present our work, ideas or features as your own.

7. Third-party data

Some data shown on RaceWatch is licensed to us by third parties, including racing, results, odds and GPS tracking data. Those providers keep their rights in it. It is supplied to you for personal use only, through RaceWatch only, and you must not pass it, or any part of it, to anyone else.

8. What you may do

You may quote a small amount of RaceWatch content, such as a single score or a short extract, for news reporting, review or personal discussion, provided you credit "Source: RaceWatch (race.watch)" and do not do it on a systematic or commercial basis. For anything more, including media and commercial licensing, contact us first.

9. How we protect our rights

We monitor for copying and misuse. Our data and content may contain unique markers that identify where they came from and which account accessed them. We keep records of account activity.

If you break these terms we may, without notice and without refund:

• suspend or close your account and refuse future sign-ups;
• issue takedown notices to hosts, platforms, app stores and search engines;
• take legal action, including for an injunction, damages or an account of profits, and recover our legal costs.

10. Reporting misuse

If you see RaceWatch content or data used without permission, email support@race.watch with the link and a screenshot.

11. Law

This page forms part of our Terms of Service. It is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
